Exhibitions Terms & Conditions JMD Art Gallery

By participating in or hosting an exhibition at JMD Art Gallery, you agree to the following terms and conditions:

1. Exhibition Participation & Artwork Submission

  • All artworks submitted for exhibition must be original and legally owned by the artist or authorized representative.

  • The gallery reserves the right to approve or decline any artwork based on curation, space availability, and relevance to the exhibition theme.

  • Any submitted work must be accompanied by proper details, including title, category (painting, sculpture, mural, etc) medium, dimensions, price (if for sale), authenticity certificate, framed/unframed and an artist statement. 

2. Exhibition Duration & Setup

  • For Physical Exhibitions:

    • The setup and dismantling of the exhibition will be scheduled by the gallery, and artists must adhere to the given timeline.

    • Artists must ensure their artworks arrive on time for installation. Delays may result in exclusion from the exhibition.

    • The gallery will oversee the placement and arrangement of artworks to maintain a cohesive display.

    For Online Exhibitions:

    • The gallery will determine the timeline for publishing and removing artworks on the online exhibition platform.

    • Any provided video content (e.g., artwork creation process) must be submitted in the specified format and resolution.

    • Artists must submit all materials within the deadline provided by the gallery. Late submissions may result in exclusion from the online exhibition.

    • Once the exhibition is live, no modifications or replacements will be accepted unless approved by the gallery.

    • The gallery reserves the right to curate the online exhibition layout, including image arrangement, descriptions, and featured artworks.

3. Sales & Commission

  • If an artwork is sold during the exhibition, JMD Art Gallery will retain an agreed-upon commission percentage, which will be mentioned in the exhibition contract.

  • Payments for sold artworks will be processed within the agreed timeframe after deducting applicable commissions and taxes.

  • Artists must provide accurate banking details for payments. The gallery is not responsible for delays due to incorrect information.

4. Artwork Handling & Liability

  • The gallery will take the utmost care in handling exhibited artworks but is not liable for damages, loss, or theft.

  • Artists are encouraged to insure their artworks independently for added protection.

  • Any special display requirements must be communicated in advance and are subject to gallery approval.

5. Promotion & Marketing

  • JMD Art Gallery will promote exhibitions through its website, social media, and marketing channels. However, artists are encouraged to promote their participation as well.

  • By participating in the exhibition, artists grant the gallery permission to use images of their artworks for promotional purposes.

6. Exhibition Fees & Charges

  • Any applicable exhibition fees will be communicated in advance. Fees, once paid, are non-refundable unless the event is canceled by the gallery.

  • Additional costs for framing, special installations, or display enhancements will be borne by the artist unless agreed otherwise.

7. Artwork Collection & Removal

  • Artworks must be collected within the designated timeframe after the exhibition ends.

  • If not collected within the given period, the gallery reserves the right to charge a storage fee or dispose of the artwork after a specified duration.

8. Cancellations & Modifications

  • JMD Art Gallery reserves the right to reschedule or cancel an exhibition due to unforeseen circumstances. In such cases, participants will be notified in advance.

  • Any artist withdrawal from an exhibition must be communicated at least [5 days] before the exhibition start date.

9. Compliance & Dispute Resolution

  • All parties must comply with local laws and gallery policies.

  • Any disputes will be resolved amicably through discussion. If unresolved, legal proceedings will be governed by the laws applicable.

  • Artists must ensure that their artwork does not infringe on any third-party copyrights or trademarks.

Buying Artwork Terms & Conditions

JMD Art Gallery ensures a seamless and transparent buying experience for collectors and art enthusiasts. By purchasing artwork from our gallery (in-store or online), you agree to the following terms and conditions:


1. Artwork Authenticity & Description

  • All artworks sold by JMD Art Gallery are original and authentic, unless otherwise stated.

  • Each artwork includes an Authenticity Certificate, unless mentioned.

  • The colors and textures of artworks may vary slightly from the images displayed online due to screen settings or photography. Buyers are encouraged to visit the gallery in person if possible before purchasing.


2. Pricing & Payment

  • The prices of artworks are fixed and non-negotiable, unless specified by the gallery.

  • Prices are listed in Indian Rupees (INR) and may include GST (18%) for orders within India.

  • For international buyers, duties, import taxes, or customs charges may apply and will be borne by the customer.

  • Payment must be made in full before the artwork is shipped or handed over.

  • Accepted payment methods:

    • Bank Transfers (NEFT/RTGS/IMPS)

    • UPI Payments (Google Pay, PhonePe, Paytm, etc.)

    • Credit/Debit Cards (Visa, Mastercard, RuPay, etc.)

    • International Payments via PayPal or Wire Transfer (Conversion fees apply)


3. Shipping & Delivery

  • We offer worldwide shipping using reliable courier partners.

  • For orders within India: Artwork will be delivered within 10 to a maximum of 30 days from the date of purchase.

  • For international orders: Delivery times may vary based on destination and customs processing.

  • Shipping charges may apply and will be communicated at checkout.

  • Buyers will receive a tracking number once the order is dispatched.

  • To collect your order from a store, please bring a printout of your confirmation and photographic proof of identity. We will notify you when your order is ready for collection.
  • JMD Art Gallery is not responsible for shipping delays caused by courier services, customs clearance, or unforeseen circumstances.


4. Returns & Refunds

  • All sales are final. No returns, refunds, or exchanges unless:

    • The artwork is damaged in transit (must be reported within 24 hours of delivery with photographic proof).

    • The artwork received is incorrect (different from the one purchased).

  • In case of an eligible return, the buyer must ship the artwork back in original condition and packaging, and the refund will be processed after inspection.

  • The gallery reserves the right to decline a return if the artwork is found to be altered, tampered with, or mishandled.


5. Ownership & Copyright

  • Upon full payment, the buyer gains physical ownership of the artwork.

  • The copyright remains with the artist, and reproduction, resale, or commercial use of the artwork without prior written consent is prohibited.

  • JMD Art Gallery and the artist retain the right to use images of the sold artwork for promotional and archival purposes.


6. Dispute Resolution

  • Any disputes regarding transactions, delivery, or artwork conditions will first be addressed through direct communication.

  • If unresolved, legal matters will be handled under the laws of Mumbai, Maharashtra, India.


 

7. Gift Cards and E-Gift Cards/Voucher Codes

  • Gift cards can be redeemed at JMD Art Gallery stores and online.

  • E-Gift cards can only be redeemed online and may be used in conjunction with transactions exceeding the card’s value.
  • They cannot be exchanged for cash or used to purchase gift or e-gift card.
  • Only one gift card, e-gift card, or voucher code may be used per transaction.
